Article 1 (Purpose)

These Terms govern the conditions and procedures for using the mobile application Daybreak (the "Service") provided by Hyunwoo Park (the "Operator"), as well as the rights, obligations, and responsibilities of the Operator and users.

Article 2 (Definitions)

1. "Service" means the Daybreak application and related services provided by the Operator, regardless of device or operating system.
2. "User" means any person who uses the Service under these Terms.
3. "Member" means a User who has created an account. Core features such as alarms may be used without creating an account.
4. "Paid Service" means subscriptions and other services provided in exchange for payment.

Article 3 (Effect and Amendment of Terms)

1. These Terms take effect upon posting within the Service or on this web page.
2. The Operator may amend these Terms to the extent permitted by applicable law. Amendments will be announced at least 7 days before their effective date, stating the changes and the effective date. Where an amendment is disadvantageous to users, it will be announced at least 30 days in advance, and will not apply to a user who does not expressly consent.
3. A User who does not agree to amended Terms may stop using the Service and delete their account.

Article 4 (Provision of the Service)

1. The Operator provides features including alarms, wake-up missions, wake verification, sleep recording and summaries, and sleep sound playback.
2. The Service is provided year-round in principle. It may be temporarily suspended for scheduled maintenance, equipment replacement, network failures, force majeure, or other unavoidable reasons, with notice given before or after the fact.
3. The Operator may modify the Service or discontinue certain features. Where a Paid Service is changed to a user's material disadvantage, the Operator will give prior notice and provide a refund for the remaining period or equivalent compensation.

Article 5 (Registration and Accounts)

1. Membership is formed when a User agrees to these Terms and completes the Operator's registration process.
2. The Service is intended for users aged 14 or older. Users under 14 may not register and must not provide personal information without the consent of a legal guardian.
3. Users are responsible for providing accurate account information and keeping it current.
4. Users are responsible for safeguarding their account and password and must not permit third parties to use them.
5. Users may delete their account at any time using the account deletion feature within the Service. Upon deletion, server-stored user data is deleted in accordance with the Privacy Policy.

Article 6 (User Obligations)

Users must not:

1. Misappropriate another person's information or register false information;
2. Reverse-engineer, decompile, copy, or redistribute the Service, or attempt to extract its source code;
3. Access the Service or collect data through automated means (bots, scripts) in an abnormal manner;
4. Interfere with the normal operation of the Service or impose excessive load on its servers;
5. Infringe the intellectual property rights of the Operator or third parties;
6. Engage in conduct that violates applicable law or public order and morals.

Article 7 (Paid Services and Payment)

1. Payment for Paid Services is processed through the payment systems of the respective app marketplaces (Apple App Store, Google Play). Payment methods, billing, and tax handling follow those marketplaces' policies.
2. Subscriptions renew automatically at the end of each period unless cancelled by the User.
3. Users cancel subscriptions directly in their app marketplace account settings. Upon cancellation, access continues for the remainder of the paid period and no further charges are made.
4. Refunds are governed by the refund policy of the respective app marketplace. The Operator cannot process refunds outside those marketplaces. This does not limit any statutory right of withdrawal available to the User under applicable law.
5. Prices may change. Price increases for existing subscribers take effect from the next renewal following prior notice, subject to the consent procedures required by each marketplace.

Article 8 (Advertising)

1. The Operator may display advertisements within the Service.
2. No advertisements are displayed on the ringing alarm screen, mission screens, or the wake verification screen. Advertisements appear only on screens shown after the wake-up flow is complete.
3. The Operator is not responsible for transactions between Users and advertisers or their outcomes.

Article 9 (Intellectual Property)

1. Intellectual property rights in the Service, including its software, design, trademarks, and text, belong to the Operator.
2. Audio assets such as alarm and sleep sounds are either works available under public domain or free licenses (e.g. CC0) or created by the Operator. Sources and licenses for each asset are listed on the "Open Source and Licenses" screen within the Service.
3. Rights in content created by Users within the Service (such as journal entries) belong to the User.

Article 10 (Restriction of Use)

The Operator may restrict a User's access following prior notice if the User violates Article 6. In urgent or serious cases, access may be restricted immediately with notice given afterward.

Article 11 (Disclaimers and Limitation of Liability)

1. Sleep records, summaries, and statistics provided by the Service are for reference only and are not intended for medical diagnosis, treatment, or prevention. Please consult a healthcare professional regarding health matters.
2. The Operator is not liable for service interruptions caused by force majeure, network failures, or changes in app marketplace or operating system policies.
3. The Operator is not responsible for the reliability or accuracy of information posted or stored by Users.
4. To the extent permitted by applicable law, the Operator's aggregate liability is limited to the amount actually paid by the relevant User to the Service during the preceding 12 months. This limitation does not apply to damages caused by the Operator's willful misconduct or gross negligence, damages to life or body, or any liability that cannot be limited under applicable law.

Article 12 (Data Backup)

A substantial portion of User data, including alarm settings and sleep records, is stored on the User's device. The Operator is not liable for data loss resulting from device resets, app deletion, or device loss. Users are encouraged to use the backup features provided by the Service.

Article 13 (Governing Law and Jurisdiction)

1. These Terms and the use of the Service are governed by the laws of the Republic of Korea.
2. Disputes shall be resolved through mutual consultation; failing that, they shall be brought before the competent court under the Korean Civil Procedure Act. A User who is a consumer may bring an action in the court with jurisdiction over their place of residence.
3. This Article does not limit any mandatory consumer rights granted to the User under the laws of their country of residence.
